TERMS AND CONDITIONS
Introduction: This program and its affiliated documents (the “Standards of Care” or “SOC”) was created by a team of athletic trainers, sports medicine physicians, physical therapists, and other contributors in conjunction with the National Athletic Trainers’ Association (the “Association”). The Association recognizes the participation of the American Orthopaedic Society for Sports Medicine, the American Medical Society for Sports Medicine, and the American Academy of Sports Physical Therapists (collectively, the “Partner Associations”) in the creation of the SOC. The SOC was created with a goal of establishing standards of care for members of the sports medicine teams, including the collegiate athletic trainer in the identified domains to reduce the instance and/or severity of injury and other negative health impacts among college athletes. The SOC is intended to serve as a general educational aid and includes information about protocols and procedures that are generally supported within the medical and athletic training communities as approaches to lessen the instances and/or impact of certain injuries. The Association and Partner Associations have made best efforts to be accurate and comprehensive in the creation of the SOC and to share references to relevant and applicable third-party resources (the “Third-Party Resources”). The SOC is meant to be updated regularly and the Association and Partner Associations welcome input and suggestions for improvement. SOC users should be aware that developments with regard to treatments, therapies, drugs, and devices occur regularly and should not assume that all SOC content represents the current state of practice. The Third-Party Resources are provided as a reference tool. The Association and Partner Associations have undertaken reasonable efforts to ensure that the links and references to Third-Party Resources as well as the information contained in such linked websites are not inaccurate but the Association and Partner Associations do not make any representation or warranty about the content of the Third-Party Resources. Waiver: THE ASSOCIATION AND THE PARTNER ASSOCIATIONS MAKE NO EXPRESS OR IMPLIED WARRANTY WITH RESPECT TO THE INFORMATION CONTAINED WITHIN OR THE RESULTS CREATED BY THE SOC OR ANY OF THE THIRD-PARTY RESOURCES. ANY MENTION OF A SPECIFIC PRODUCT, COMPANY, OR ORGANIZATION IS NOT INTENDED AS AN ENDORSEMENT BY THE ASSOCIATION OR THE PARTNER ASSOCIATIONS. Release: Each user understands, acknowledges, and agrees that, in consideration for having access to the SOC, the user hereby releases, discharges, and holds harmless, individually and collectively, the Association and the Partner Associations, and each of their respective affiliates, officers, directors, employees, committee members, members, subsidiaries, agents, successors, and assigns, from any and all liabilities that may arise, directly or indirectly, now or in the future, by reason of or in connection with any decision, action, or omission relating to the user’s use of the SOC. License Grant: The Association and Partner Associations grant to the user a limited, revocable, non-exclusive, nontransferable, non-sublicenseable, personal license to download, install, and operate the SOC and its related content (collectively, “Association Content”). The content layout, formatting, and features of and access privileges for the SOC shall be as specified by the Association and Partner Associations in their discretion. Restrictions. Notwithstanding the foregoing, the user may not modify, translate, decompile, create derivative work(s) of, copy, distribute, disassemble, broadcast, transmit, publish, remove, or alter any proprietary notices or labels, license, sublicense, transfer, sell, mirror, frame, exploit, rent, lease, private label, grant a security interest in, or otherwise use in any manner not expressly permitted herein the Association Content. User Obligations. By using the SOC, each user represents that they are at least eighteen (18) years of age (or the legal age of majority (whichever is greater). In addition, the user agrees to abide by all applicable local, state, national, and international laws and regulations with respect to its use of the SOC. The user also acknowledges and agrees that use of the Internet and access to the SOC is solely at the user’s own risk. The Association and Partner Associations are not responsible for the security of any information transmitted to or from the SOC and does not guarantee confidentiality to users. Other Terms and Conditions. These Terms and Conditions are intended to be and are in fact supplemental to and not in replacement of any additional terms and conditions imposed on users through, for example, accessing the Association or Partner Associations websites, becoming a member of the Association or Partner Associations, or others participating in Association or Partner Associations programs and activities. In the event these Terms and Conditions are in direct conflict with other applicable terms and conditions, the applicable provision in these Terms and Conditions shall control.
